These Terms and Conditions of Use (“Terms”) govern the access and use of the Services (as defined below) provided by GURCHARANAM ACADEMY PRIVATE LIMITED (“GURCHARANAM,” “Company,” “we,” “us,” or “our”) through its online and offline platforms (“Platform”). GURCHARANAM ACADEMY PRIVATE LIMITED is a private limited company incorporated under the laws of India, having its registered office at Kota, Rajasthan – 324005.
GURCHARANAM provides academic services under multiple brands, including GURCHARANAM DISTANCE LEARNING PROGRAM, designed to guide and prepare students for competitive examinations such as NEET-UG, IIT-JEE, NTSE, Olympiads, and other foundational and pre-nurture programs. These services are tailored to assist students who are unable to attend classroom programs and wish to study remotely using quality content delivered through our proprietary platforms.
1. Acceptance of Terms
1.1 Legal Agreement
These Terms constitute a legally binding agreement between the User (referred to as “User,” “you,” or “your”) and the Company. By clicking “I Agree” or “I Accept,” or by accessing, registering, or using the Platform and its Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
If you do not agree to these Terms, you must immediately discontinue access and use of the Platform.
These Terms apply even if you are only browsing the Platform or reviewing available services without becoming a registered or subscribed user.
1.2 Definitions
- “Platform” refers to any digital or physical medium (including websites, mobile apps, printed content, and offline media) through which Services are provided.
- “Services” include but are not limited to: video lectures, test series, study materials, question banks, notes, and mentoring sessions.
- “User” includes any natural or legal person accessing the Platform, whether as a visitor, registered user, or subscribed user.
- “Subscribed User” refers to any User who has completed the subscription process and is authorized to access premium content on the Platform.
1.3 User Commitments
By using the Platform, the User agrees:
- To provide true, accurate, current, and complete information during registration and to keep such information updated.
- That the Company is not responsible for verifying the eligibility of any User, and Users are solely responsible for ensuring they meet all eligibility criteria.
- If the User is a minor, they must obtain the consent of a parent or legal guardian before providing personal information or subscribing to Services.
- That the User is liable for any misuse of the Platform or its content that causes damage, loss, or injury to any third party.
- That the Company reserves the right to:
- Update, modify, or replace any content or feature, including but not limited to videos, notes, tests, or faculty, without prior notice.
- Engage alternate faculty or tutors at its discretion at any time without notification.
1.4 Suspension or Termination
If any information provided by the User is found to be untrue, inaccurate, incomplete, or misleading, or if the Company has reasonable grounds to suspect such inaccuracy, we reserve the right to suspend or terminate the User’s account, and to deny current or future access to the Platform or Services.
1.5 Nature of Document
This document constitutes an electronic record under the Information Technology Act, 2000 and related rules. It does not require any physical or digital signature.
1.6 Limited License
Subject to these Terms, Users are granted a limited, non-exclusive, non-transferable, non-commercial, and revocable license to access and use the Platform for personal educational purposes only. The Company retains exclusive ownership of the Platform and all associated intellectual property.
Users may access free demo content prior to subscribing. Full access is granted only after the User becomes a Subscribed User as defined herein.
1.7 Consent to Communication
By registering your email address and/or phone number with us, you consent to being contacted by GURCHARANAM through:
- Phone calls,
- SMS,
- Emails,
- WhatsApp, and/or
- Other electronic communication methods.
This communication may relate to service updates, subscription details, promotional offers, or customer support, and is subject to our Privacy Policy.
1.8 User Responsibilities
- Users are solely responsible for maintaining the security and confidentiality of their login credentials.
- The Company shall not be liable for any unauthorized access to User accounts. However, the User may be held liable for any losses incurred by the Company due to such unauthorized usage.
- The User must not share or resell account access or Platform content.
1.9 Compliance with Laws
Given the global nature of the internet, the User agrees to comply with:
- All applicable local, state, and national laws;
- International laws applicable to digital services;
- Laws regarding the export of technical data or software from India or the User’s country of residence.
1.10 Updates to Terms
We reserve the right to update or modify these Terms at any time without prior notice. Any such changes will be posted on this page with a revised “Last Updated” date. Continued use of the Platform after changes constitutes your acceptance of the updated Terms.
1.11 Third-Party Platforms
These Terms apply only to our Platform. We are not responsible for the terms, content, or services of any third-party platforms, even if they are linked from or related to our services.
2. Eligibility
2.1 Competency to Contract
Use of the Platform and registration as a user is permitted only to individuals who are competent to contract as per the provisions of the Indian Contract Act, 1872. Persons who are “incompetent to contract” under the Act, including minors, undischarged insolvents, and persons of unsound mind, are not eligible to use the Platform.
If the User is a minor (i.e., under the age of 18 years), such access and use shall be permitted only through the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on behalf of the minor. By allowing a minor to use the Platform, the parent or legal guardian affirms that:
- They have read and understood these Terms, and
- They consent to the minor’s use of the Platform and its Services.
The Company will presume that all access by minors is authorized and consented to by their parent or legal guardian.
2.2 Specific Academic Eligibility
To enroll in the GURCHARANAM DISTANCE LEARNING PROGRAM, the User must be a student enrolled in distance learning programs for JEE Main, JEE Advanced, or NEET-UG (i.e., engineering or medical streams). Users must also meet any other specific eligibility criteria as prescribed by the Company from time to time.
2.3 Registration & Subscription Requirements
To avail the Services (as defined in Clause 3.1), the User must register for an account on the Platform. The registration process includes:
- Filling in all mandatory details in the subscription enrollment form.
- Selecting an appropriate subscription plan.
- Making the necessary payment.
Upon successful registration and receipt of payment, the User becomes a ‘Subscribed User’. Until payment is made, the User will only have access to the Platform as a ‘Free User’ and be eligible to view limited demo content or any free material made available.
2.4 Free Users vs. Subscribed Users
- A Free User is granted access only to limited “free content” or “basic plan” features for trial and preview purposes.
- A Tentative Subscribed User is a User who has selected a paid plan and completed the payment, but whose identity verification (if applicable) is pending.
- A Subscribed User is a User whose payment has been processed and whose registration has been confirmed via email and, where required, whose identity verification has been successfully completed.
2.5 Subscription Confirmation
Upon completion of payment:
- The Tentative Subscribed User will receive a confirmation email at the registered email address, outlining the selected plan and providing account credentials.
- The subscription shall be deemed active only upon:
- Receipt of full payment,
- (If applicable) Successful identity verification as outlined in Clause 2.6.
2.6 Identity Verification
To maintain a secure and verified user environment, the Company reserves the right to request valid proof of identity and address for all Subscribed Users. The process is as follows:
(a) For Users within India:
Users may be required to submit a valid Government of India-issued ID proof, such as:
- Aadhar Card
- PAN Card
- Voter ID
- Passport
- Driver’s License
(b) For Users outside India:
Alternative identity and address proof documents may be requested, at the sole discretion of the Company.
2.7 Identity Verification Procedure
As part of the verification process, the Company will:
- Collect, store, and process the User’s identity documents only for verification purposes, in accordance with our Privacy Policy.
- Use encryption mechanisms to protect User data. Identity information will be:
- Encrypted upon receipt,
- Decrypted solely for verification,
- Re-encrypted and stored securely after verification.
- Follow reasonable security practices as mandated by applicable laws to safeguard User information and ensure data privacy and confidentiality.
3. Services of GURCHARANAM DISTANCE LEARNING PROGRAM
3.1 Subscription Requirement
To avail the full range of course content and features available on the Platform, the User must be a Subscribed User, having fulfilled all conditions under Clause 2 (Eligibility).
3.2 Plan-Based Service Access
The specific Services and associated fees vary depending on the:
- Course combination chosen during the initial subscription, or
- Additional courses later added by the Subscribed User.
Fees are based on the selected package and service duration.
3.3 Definition of Services
For the purpose of these Terms of Use, “Services” shall refer to the value delivered to Subscribed Users via course material and features accessible through the Platform. This includes, but is not limited to:
- Study Materials
- Test Series
- Video Lectures
- Doubt-Clearing Sessions
- Interactive Assessments
Services do not include any free or demo content made available to all visitors. The scope of Services may be expanded or modified at the sole discretion of the Company.
3.4 Free Plan Access
All Users are enrolled by default into a Free Plan, which provides access to limited preview content. Users may choose to upgrade to a paid subscription at any time.
3.5 Right to Modify Services
The Company reserves the right, at its sole discretion, to:
- Add, remove, or modify existing offerings.
- Revise the subscription fees for any current or future Services.
- Modify the structure or features of the Platform without prior notice.
These changes may affect Free Users, Tentative Subscribers, or Subscribed Users alike.
3.6 Revisions to Fees
All fees and pricing associated with existing or future Services may be revised, updated, or restructured by the Company at any time. Continued use of the Platform after such changes will constitute acceptance of the revised pricing terms.
4. Subscriber Account, Password, and Security
4.1 Account Creation and Access
To use the Platform and access the Services, Users must:
- Register by submitting a valid email address and/or phone number.
- Choose a secure password to create a user account.
These credentials form the sole basis for accessing and maintaining a subscription.
4.2 Responsibility for Account Security
Users are solely responsible for:
- Maintaining the confidentiality of their login credentials.
- Ensuring that their account is used only by them.
If a User suspects that their credentials have been compromised, they must immediately:
- Use the ‘Forgot Password’ feature to reset the password, and
- Notify the Company, if necessary.
The Company will not be liable for any unauthorized access resulting from User negligence.
5. Third-Party Services and Content
5.1 Third-Party Integration
We may integrate or utilize third-party platforms to offer our Services. Where applicable:
- Users are subject to the terms, privacy policy, and policies of such third-party providers.
- Use of such integrated services indicates your agreement to be bound by their rules.
5.2 Content Disclaimer
While the Company reviews content made available through its Platform, it:
- Disclaims any warranties regarding the accuracy, completeness, or reliability of such content.
- Makes no guarantee that the information reflects the latest updates or standards on the subject matter.
5.3 External Links and Websites
The Platform may include links to third-party websites or platforms (e.g., affiliate partners, advertisers). The Company:
- Has no control over the content or policies of these external sites.
- Disclaims any liability arising from a User’s decision to visit or rely on content from such websites.
- Does not endorse or verify the accuracy of such third-party content.
Users access third-party links at their own risk.
5.4 Third-Party Reliance Disclaimer
We are not responsible for any actions, decisions, or consequences arising from:
- A third-party relying on information obtained from the Platform.
- Any advice given by a User to a third party based on our content or Services.
5.5 Educational Use Only
All study materials, tutorials, and videos are intended strictly for:
- Personal learning
- Educational enhancement
The Company assumes no responsibility for the misuse of such materials for non-educational purposes, such as third-party consulting, business, or professional advice.
6. Payment Terms
6.1 Applicable Payment Terms
All payments made by Users for accessing the Services are subject to the payment terms of GURCHARANAM DISTANCE LEARNING PROGRAM, as communicated to the User during the subscription process. The current payment plans and applicable charges are available on the Platform.
6.2 Fee Disclosure
The total Fee, including applicable Goods and Services Tax (GST) and any delivery or processing charges, will be displayed prior to the completion of the payment process.
6.3 Correction of Pricing Errors
In the rare event of a pricing error on the Platform:
- The Company will notify the User at the earliest possible opportunity.
- If the actual Fee is higher than what was initially displayed, the User will be contacted via their registered email or phone.
- Continued access to the full Services is conditional on payment of the correct Fee.
6.4 Third-Party Payment Gateways
All subscription payments are processed via third-party payment gateway providers. Users acknowledge and agree that:
- The Company is not responsible for any technical issues, errors, or payment failures that occur at the bank’s end or through the third-party gateway.
- Any such disputes must be resolved directly with the concerned financial institution or gateway provider.
- The names and terms of such third-party providers will be made available to Users as part of the payment process.
6.5 Payment Confirmation and Service Activation
Access to any paid Services is subject to successful receipt of cleared funds by the Company. If payment is not received by the due date:
- The Company may suspend or deny access to the relevant subscription plan.
- The Company reserves the right to take any appropriate action at its sole discretion, without prejudice to other rights and remedies available under these Terms.
6.6 App Store/Play Store Transactions
If the Platform is accessed via iOS or Android apps, Users:
- Should visit the official GURCHARANAM website to manage their subscription account.
- May also be subject to the terms and conditions of the Apple App Store or Google Play Store, as applicable.
7. Disclaimer Regarding Study Materials
7.1 Definition of Study Materials
The term “Study Materials” includes, but is not limited to:
- Offline lectures
- Video tutorials
- Digital or physical notes
- Question banks
- Test series
- Any other learning resources provided in hard copy or electronic format
These materials are made available only to Subscribed Users who meet the eligibility and payment requirements as stated in these Terms.
7.2 No Guarantee of Error-Free Content
While efforts are made to ensure the quality of content, the Company does not guarantee that:
- Demo or full-version Study Materials are free from errors or inaccuracies.
7.3 “As-Is” Basis
All Services and accompanying Study Materials are provided on an “AS IS” basis, without warranties of any kind, express or implied.
7.4 Content Updates and Revisions
The content of the Platform, including Study Materials, may be added to, modified, or removed:
- Without prior notice to the User, and
- At the sole discretion of the Company.
There is no obligation to retain or continue offering any previous versions of content.
7.5 No Academic Outcome Guarantee
The Company makes no promises or guarantees regarding:
- Ranks, scores, success, or any other outcomes in entrance or academic exams.
Use of the Platform does not assure any particular academic or professional advantage.
7.6 Dynamic Content and Curriculum
The Company reserves the right to:
- Continuously update and revise the Study Materials to reflect the latest educational standards, evidence, and practices.
- Replace older versions with newer formats or revised features without retaining prior versions.
7.7 Faculty Changes
The Company retains the exclusive right to:
- Appoint, replace, or change faculty members or tutors delivering the Study Materials at any time, and
- Do so without prior notification to the User.
8. Online Subscription and Access Terms
8.1 Scope of Subscription
Except as explicitly stated in the subscription plan selected by the User on the Platform, no additional Study Materials shall be provided by GURCHARANAM DISTANCE LEARNING PROGRAM.
8.2 Activation and Duration of Access
Upon successful registration and receipt of payment:
- A confirmation email will be sent to the User.
- The email will specify the activation date and the duration of access to the purchased Services.
- Access is subject to the Company’s right to suspend or terminate such access in accordance with these Terms of Use.
8.3 Non-transferability of Subscription
All Subscriptions—whether tentative or confirmed—are:
- Personal and non-transferable to any third party.
- Not to be sold, shared, or sublicensed, whether for consideration or otherwise.
Any such unauthorized activity constitutes a breach of these Terms and may result in immediate suspension or termination of the User account without prior notice, at the sole discretion of the Company.
9. Offline + Online Subscription and Access Terms
9.1 Scope of Access
No Study Materials other than what is described in the selected subscription model will be provided. This includes both online and offline resources.
9.2 Notification and Access
Upon successful subscription:
- The User will receive a confirmation email specifying:
- The activation of online Services, and
- The schedule/timetable for offline lectures.
- Access will remain valid for the duration specified, subject to the Company’s right to suspend or terminate at its sole discretion and without prior notice.
9.3 Non-transferability and Misuse
The subscription and all accompanying materials are:
- Personal to the Tentative or Subscribed User.
- Must not be transferred, resold, or granted to another party for any purpose.
Violation of this provision constitutes a material breach of the Terms of Use and may result in immediate account suspension or termination.
10. System Requirements
10.1 Responsibility of Compatibility
Users are solely responsible for ensuring that their systems or devices meet the minimum technical requirements necessary to access the Services. The Company shall not be liable for:
- Any playback or content delivery issues.
- Compatibility failures due to outdated or unsupported software/hardware.
10.2 Minimum Device Requirements
To access the Platform effectively, Users must meet the following baseline system criteria:
- Android Devices:
- Minimum OS: Android 5.1
- Device must be non-rooted
- Must support DRM
- iOS Devices:
- Minimum OS: iOS 11
- Device must be non-jailbroken
- Browser Recommendation:
- Google Chrome (latest version) is highly recommended
- Compatibility with other browsers is not guaranteed
10.3 Internet Bandwidth Requirements
Minimum internet speeds required:
- Videos: 0.8 Mbps
- Other Services (quizzes, PDFs, etc.): 0.2 Mbps
Recommended speeds for optimal experience:
- Videos: 2 Mbps
- Other Services: 2 Mbps
10.4 Performance Disclaimer
The above system and internet specifications are based on empirical user data and provided for guidance only. They do not guarantee uninterrupted performance, as other factors such as:
- Network congestion
- Device limitations
- Background applications
may affect the user experience.
1. Modifications to Subscription
11.1 Right to Modify
GURCHARANAM DISTANCE LEARNING PROGRAM reserves the right to:
- Modify, enhance, or issue clarifications to the subscription,
- Change the nature, volume, features, or pricing of Services,
- Adjust the validity or duration of subscriptions, including but not limited to the introduction of doubt-clearing sessions or interactive components.
11.2 Notification of Changes
While We may notify Users of any modifications, We are not obligated to do so. All Users agree to be automatically bound by such updates and changes upon their publication on the Platform.
11.3 Discretionary Authority
All modifications shall be at the sole and absolute discretion of the Company and shall not be subject to challenge by the User at any time.
11.4 Content Availability
We do not guarantee continued availability of any content or features from earlier versions following the launch of updated or new editions of the Platform or Services.
12. Technical Support and Access
12.1 No Guarantee of Uninterrupted Access
We do not warrant that the operation of the Platform or access to Services will be uninterrupted or error-free.
12.2 Limited Support Obligations
Technical support will be limited to the specific assistance included in the User’s chosen subscription plan. Beyond that, the Company has no further obligation to provide additional support.
13. Disclaimers
13.1 External Network & Security Risks
The Company shall not be liable for any:
- Network or internet-based interruptions,
- Device compatibility issues related to DRM (Digital Rights Management),
- Security breaches such as viruses, hacking, or malware originating from third-party networks or ISPs.
13.2 Nature of Platform Recommendations
All recommendations or suggestions made on the Platform are advisory in nature. Users may act on them solely at their own discretion.
13.3 “As-Is” Provision
All Services, content, and materials are provided strictly “AS IS” without warranties of any kind, either express or implied, including but not limited to:
- Accuracy,
- Suitability for a particular purpose,
- Non-infringement,
- Uninterrupted availability or operation.
13.4 No Guarantee of Continuous Operation
The Company does not warrant:
- Uninterrupted access to the Website or Services,
- That technical operations such as uploading, downloading, or streaming will function without delays or errors.
13.5 Release of Liability
By using the Platform, Users explicitly agree to release the Company, including its directors, officers, employees, agents, and representatives, from any liability arising from the use of the Platform or Services.
13.6 Force Majeure
The Company shall not be liable for failure or delay in fulfilling its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet outages, or third-party service disruptions.
13.7 Limitation of Liability
To the extent permitted under applicable law:
- The maximum aggregate liability of the Company, its employees, partners, and agents for any claims under these Terms shall not exceed the total payments actually received and retained from the User for the Services in question.
- Non-Subscribed Users shall not be entitled to bring any claims or demand any liability from the Company under any circumstances.
13.8 No Liability for Indirect or Consequential Damages
Under no event shall the Company be liable for any:
- Loss of profit (actual or anticipated),
- Loss of business opportunity,
- Loss of data or goodwill,
- Incidental, consequential, indirect, special, or punitive damages,
whether arising in contract, tort, or otherwise, even if advised of the possibility of such damages.
13.9 Jurisdictional Limitations
The Platform and Services are intended for use within India. Users accessing from outside India do so at their own risk and are solely responsible for compliance with local laws. If local laws prevent the exclusion of certain warranties or limitation of liability, such provisions shall apply only to the extent permitted by law, and all remaining provisions will remain in full force and effect.
14. Data Protection
14.1 Processing and Use of Personal Information
All personal data collected from the User or otherwise held by GURCHARANAM DISTANCE LEARNING PROGRAM will be processed in accordance with these Terms of Use and our Privacy Policy.
By using the Platform, the User consents to the collection, storage, and usage of such personal data as outlined in these Terms and the Privacy Policy.
14.2 Responsibility for Data Backup
The Company shall not be held responsible for any data loss incurred by the User, whether due to:
- Accessing tutorials or study material,
- Any technical issues,
- Or any other cause during the course of the subscription.
It is the User’s sole responsibility to regularly back up:
- All data stored on the device(s) used to access the Platform,
- Any data inputted while completing a course or module.
15. Fair Usage and Account Sharing Policy
15.1 Single User Access
Each GURCHARANAM DISTANCE LEARNING PROGRAM account is strictly intended for use by a single, individual User.
15.2 Prohibition on Sharing
Sharing of login credentials for personal or commercial purposes is strictly prohibited. Any such sharing will result in:
- Immediate account suspension or termination,
- Without prior notice, and
- At the sole discretion of the Company.
15.3 Monitoring and Detection
The Company reserves the right to monitor usage patterns and assess access logs or technical parameters to detect:
- Shared access,
- Unauthorized usage, or
- Breach of fair usage.
15.4 Consequences of Violation
Any violation of this policy shall be deemed a material breach of the Terms of Use and may result in:
- Permanent account suspension,
- Legal action as per applicable laws of India,
- Forfeiture of any amounts paid without refund.
16. User Generated Content
16.1 Prohibited User Content
Users shall not use the Platform to upload, share, transmit, display, or distribute any content that:
- Violates any applicable law or regulation;
- Infringes upon any intellectual property or proprietary rights of others;
- Belongs to another person and is used without authorization;
- Is obscene, pornographic, sexually explicit, or otherwise offensive;
- Harms or exploits minors;
- Deceives or misleads others, including misinformation or fake content;
- Impersonates any person or entity, or falsely states or misrepresents affiliation with any entity;
- Contains malicious code, viruses, or any program intended to disrupt, destroy, or interfere with the Platform;
- Threatens national security, public order, or promotes enmity between communities or countries.
16.2 Compliance Responsibility
Users agree to fully comply with all applicable laws and regulations when using the Platform and acknowledge that any violation of the above clauses may result in:
- Legal consequences,
- Suspension or termination of account,
- Reporting to authorities if required.
17. Termination or Suspension of Account for Illegal Activities
17.1 Right to Suspend or Terminate
If GURCHARANAM DISTANCE LEARNING PROGRAM suspects or identifies any illegal, unethical, or unauthorized activity, it reserves the unilateral right to:
- Immediately suspend or terminate the User’s account,
- Cancel active subscriptions,
- Block future access to the Platform,
- Take legal action under applicable law.
17.2 Illustrative List of Violations
Without limitation, the following conduct may trigger termination or suspension:
- (a) Suspicious, high-risk, or abnormal login or usage patterns,
- (b) Use of any recording devices (including mobile phones or cameras) to capture Platform content,
- (c) Sharing, publishing, or circulating Platform content on social media or other platforms (including screenshots, PDFs, or any study materials),
- (d) Sharing account credentials with any third party,
- (e) Using more than two devices per user (unless specifically permitted),
- (f) Abusive behavior or defamatory comments directed towards the Company or its representatives.
18. Preservation and Disclosure of Information
18.1 User Consent
The User acknowledges and expressly consents that GURCHARANAM DISTANCE LEARNING PROGRAM may access, preserve, and disclose User account information, including data and usage history, in any of the following circumstances:
- To comply with applicable legal obligations, court orders, or governmental requests — whether under domestic or international law;
- To enforce these Terms of Use or investigate potential violations thereof;
- To respond to any claims or allegations that content provided by the User infringes the rights of any third party;
- To protect the rights, property, or personal safety of GURCHARANAM DISTANCE LEARNING PROGRAM, its users, subscribers, or the general public;
- In accordance with the Privacy Policy, for marketing, promotional, or service-related communications, through any communication channel deemed appropriate by the Company.
19. Proprietary and Intellectual Property Rights
19.1 Ownership of Materials
All content, features, and materials available on the Platform — including, but not limited to, trademarks, trade names, service marks, logos, designs, graphics, software, study materials (hard and soft copies), text, audio, video, photos, artwork, and any derivative works thereof (collectively, the “Material”) — are the sole and exclusive property of the Company and/or its licensors. These are protected under applicable intellectual property laws, including copyright and trademark law.
19.2 Limited License to Use
The User is granted a personal, revocable, non-exclusive, non-transferable, and non-commercial license to access and use the Platform and Materials solely for the purpose of availing the subscribed Services on authorized devices.
No license or right is granted to the User to copy, distribute, reproduce, modify, republish, upload, or transmit any Material, except as explicitly authorized in writing by the Company.
19.3 Prohibited Acts
The User shall not, under any circumstance:
- Modify, delete, distort, or create derivative works from the Material;
- Use the Platform or Material for any purpose other than the intended educational use;
- Reproduce, transmit, store, publish, or disseminate any part of the Material without prior written authorization from the Company;
- Reverse engineer, decompile, disassemble, decode, or attempt to derive the source code of the Platform or any proprietary software or technology;
- Use any automated means or manual process to access, scrape, or copy the Platform’s data or Materials for commercial use or redistribution;
- Record, mirror, frame, broadcast, or upload any Material, including offline lectures, tutorials, or study materials on any other platform, forum, or network;
- Distribute, sell, sublicense, or commercially exploit the Material or Services in any manner;
- Attempt to or assist any other person to do the above activities.
19.4 Anti-Piracy and Monitoring
As part of its anti-piracy efforts, the Company may deploy technological tools or software with embedded security and monitoring mechanisms to:
- Detect illegal duplication or unauthorized distribution of Materials,
- Identify unauthorized use or piracy,
- Transmit related metadata or information back to the Company for investigation.
The User explicitly consents to the operation of such mechanisms for the protection of the Company’s intellectual property.
19.5 Duty to Report Infringement
Users are obligated to promptly notify the Company of any suspected instances of counterfeiting, piracy, or infringement of the Company’s intellectual property. Users agree to fully cooperate with the Company in investigating and taking legal action against such infringements.
19.6 Consequences of Violation
Any violation of this Clause 19 shall constitute a material breach of these Terms of Use. In such cases:
- The Company may immediately terminate the User’s account and access to the Platform;
- The Company reserves the right to pursue all legal remedies, including civil and criminal proceedings;
- The User shall be liable for unlimited damages and losses, including legal fees, incurred due to such violation.
20. Terms and Termination
20.1 Duration of Agreement
These Terms of Use shall remain in full force and effect for as long as the User continues to access or use the Platform.
20.2 Termination by User
The User may terminate their subscription at any time by contacting the support channels provided by GURCHARANAM DISTANCE LEARNING PROGRAM.
Please note that:
- Termination initiated by the User shall be governed strictly by the Company’s Subscription and Refund Policy.
- No refunds will be issued for voluntary termination or discontinuation of Services.
20.3 Termination or Suspension by the Company
We reserve the right to, with or without prior notice, terminate, suspend, edit, modify, or discontinue the Platform or Services (in whole or in part) for any reason, including but not limited to:
- Breach of any provisions outlined in these Terms of Use or the Privacy Policy;
- Provision of false or misleading information;
- Conduct that interferes with the use or enjoyment of the Platform by others;
- Any other reason deemed appropriate by the Company.
Such actions may be taken without liability to the User or any third party.
21. Indemnification
21.1 User Obligations
The User agrees to defend, indemnify, and hold harmless GURCHARANAM ACADEMY PRIVATE LIMITED, its affiliates, subsidiaries, directors, officers, employees, agents, consultants, subcontractors, and representatives from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees), arising out of or in connection with:
- The User’s access to and use of the Platform and/or any content therein;
- Any third-party reliance on User representations made through use of the Services;
- Breach of any provision of these Terms of Use or the Privacy Policy;
- Violation of any third-party rights, including but not limited to intellectual property, proprietary, or privacy rights.
22. Additional Terms
22.1 Non-Transferability
This Agreement and any rights or licenses granted hereunder are personal to the User and may not be transferred or assigned by the User. However, the Company reserves the right to assign its rights and obligations under this Agreement without restriction.
22.2 Severability
Each provision of these Terms of Use shall be interpreted separately. If any part is determined to be invalid, unenforceable, or unlawful, such provision shall be deemed severed and modified only to the extent necessary to make it valid, while the remaining provisions shall remain in full force and effect.
22.3 Entire Agreement
These Terms of Use, along with the Privacy Policy, Payment Terms, Subscription Plan Details, and any other legal notices or disclaimers published on the Platform, constitute the entire agreement between the User and the Company. This agreement supersedes any prior understandings, oral or written, regarding the subject matter herein.
22.4 No Waiver
Failure by the Company to enforce any provision of these Terms shall not be deemed a waiver of such provision or any other provision of this Agreement.
22.5 Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Kota, Rajasthan, India.
